Klepps, Inc. may change this Policy from time to time by updating this page. You should check this page from time to time to ensure that you are aware of any changes and that you have the most up to date information. Any changes made, take effect immediately once they are published on this site. This Policy is effective 12/01/2010.

PLEASE TAKE THE TIME TO READ THE FOLLOWING TERMS AND CONDITIONS UNDER WHICH KLEPPS INC. AGREES TO PROVIDE YOU WITH THE INSTALLATION AND PRODUCT SERVICES DESCRIBED ON THE PROVIDED ESTIMATE OR INVOICE.

THIS AGREEMENT IS BETWEEN YOU AND KLEPPS, INC.. BELOW ARE THE DETAILS OF YOUR CONTRACT (“AGREEMENT”):

Warranty

Limited One Year Installation Warranty:
Klepps Inc. shall provide You with a 1-year limited warranty on all labor Included with professional installation services. This warranty is valid from the “Completion Date” as indicated on your invoice and with the exceptions indicated hereof. Klepps Inc. will correct any installation and wiring defects at no cost to you if Klepps, Inc. is notified of the defect within one year from the date of completion listed on the invoice.

Commencement of Installation Warranty:

This warranty shall not become effective, nor will Klepps, Inc. have any obligation under this warranty until all monetary obligations for materials and services related to this installation or subsequent repairs, or inspections are paid in full by You. After full payment is received, the warranty will not be extended to make up for the lost time; it will end one year from the date of completion listed on the invoice.

Any modification of the product or the work performed by Klepps, Inc. in any way, by any party other than Klepps, Inc. will void the warranty.

Waiver:

Klepps, Inc. failure at any time to enforce any conditions stated herein shall not be construed as a waiver of any provision of this warranty.

Installation Service Returns:

Installation Service returns cannot be accepted after installation or consultation services are completed.

Products Return/Replace/Repair:

All products are covered by manufacturer’s return/replace policy. Klepps Inc. will assist to obtain replacement or repair if equipment fails. All other returns are accepted within 30 days and are subject of 20% restocking fee.

Limitations to Installation Service:

The above Klepps Inc. warranty for labor related to installation services shall not apply in if your inability to use the products, or your less than satisfactory use of the products installed by Klepps, Inc., is due to failure of the product:

• Klepps, Inc. is not responsible or liable in any way for defects in the product or any equipment, parts or materials used in connection with the services that were not provided by Klepps, Inc.. Any claim arising from such defects shall be made solely against the manufacturer or the retailer from which you purchased such products.
• This limited warranty does not Include any warranty on the equipment or any related parts sold and installed by Klepps, Inc.. The manufacturer of the products installed by Klepps Inc. is solely responsible for all warranties, if any, related to such products. However, Klepps Inc. will assist in all possible ways to obtain replacement or repair if equipment fails.

• Repairs necessitated by software problems, or as a result of alteration, additions or deletions, adjustment and repair services which are necessary due to manufacturer’s recall of electronic devices or components are not Included.

This Agreement does not cover repairs or damages as a result of:

(i)            accident, misuse, neglect, failure to follow instructions for proper use, care or cleaning of the product or abuse of the product (such as, but not limited to, use of incorrect line voltages, use of incorrect fuses, use of incompatible devices or accessories, improper or insufficient ventilation, failure to follow operating instructions, or use of out of specification supplies),

(ii)           modification of the product or the provision of installation services by any party other than Klepps, Inc.;

(iii)         an act of God such as, but not limited to, lightning, flooding, tornado, earthquakes, and hurricanes,

(iv)          failure due to an external factor (fire, flood, failures or fluctuations of electrical power or air conditioning),

(v)           the loading of software, software configurations or any data files, or

(vi)          the moving of the products or components from one geographic location to another or from one purchaser to another.

(vii)        any cause other than the labor services provided by Klepps, Inc.;

Responsibility:
Klepps, Inc. installation technicians will not be held responsible for moving any furniture or valuables.

Klepps, Inc. installation technicians will not, under any circumstances, move, alter, or install electrical outlets. It is recommended to have necessary electrical work performed prior to your installation appointment.

Limitation of Liability & Release:
Except for direct property damage, personal injury or wrongful death that results from our installation technician's gross negligence or willful misconduct, under no circumstances shall Klepps, Inc. be liable to you or any other person for any damages, including without limitation, any indirect, incidental, special or consequential damages, expense, costs, profits, lost savings or earnings or liability arising out of, or related to, the services provided by Klepps, Inc. or the installation, un-installation, use of or inability to use your products. Further, by purchasing and allowing the performance of installation services by Klepps Inc. you agree to release and hold harmless Klepps Inc. against any loss, liability or damage that you or the owner or lessee may suffer, included but not limited to any changes or alterations to your residence (for example, changes to walls, baseboards, floors, etc.).

Some states do not allow limitations or release of certain damages or liability, so the above limitation of liability and release may not apply to you.

Scope of Work:
Please reference provided estimate or invoice for the applicable installation or service details.

Installation Authorization:
For Services provided at your residence, an adult (at least 18 years of age) must be present at all times during the service technician’s visit to approve all work completed.

We are required by the State of Washington to collect sales tax based upon the rate applicable at the location where the purchaser takes receipt of the products or labor.

Klepps, Inc. does not benefit from the collection of sales tax and we remit all taxes collected directly to the appropriate taxing jurisdiction.

Sales tax is based on the Ship-To-Address and the sales tax rate in effect at the time your payment is received.

If the sales tax rate changes before the full payment is received, the new rate will apply for the unpaid balance.

If the Ship-To-Address is not provided at the time an estimate is issued, actual sales tax will be re-calculated based upon the Ship-To-Address you provide; please be aware that as a result, the amount of the total balance may change.

Costs and Payments

Costs:

• Regular hourly charge: $85.00 per hour, per installer; minimum 2 hours per service;  

• Cancellation fee: $100.00;
• Round trip charge: $1.50 per mile if more than 20 miles round trip; Includes man and truck;
• A surcharge of $34 will be assessed on all returned checks;

Payment for Products and Installation Services:

However, for installation services that exceed $1000.00 we require payment as following:

Any payment agreement, if any, stated on provided estimate/ invoice will enforce the conditions stated herein. 

We reserve the right to ask that proof of funds be made available to complete the project in its entirety. Proof of funds can be presented in a certified or notarized letter from a bank or other financial institution only. Handwritten letters are not acceptable.

Failure to make payments as outlined will constitute a breach of contract by You and work will promptly terminate until payment has been remitted, processed, and the funds are made available.  

As methods of payment, we accept personal or business checks, cashier’s check, bank transfer or credit cards through PayPal. You do not have to have a PayPal account in order to pay with a credit card through PayPal.

Past due balances are subject to service charge of 1.5% per month (18% annual). In the event of legal action to enforce payment, all costs of collection including attorneys fee, will be assessed and added to balance due. We reserve the right of lien on property or business if payments are not met as scheduled and / or final payment is 30 days late from project’s date of completion.

Additional Charges / Change Order
In some rare cases installation technicians will determine that work requested is outside of your purchase service type. You may purchase such additional services by authorizing technicians to add such additional services to the installation work order.

Conditions Affecting Klepps, Inc. Services:
Klepps Inc. shall not be liable for any failure or delay in performance due to any cause beyond its reasonable control. If Klepps Inc.‘s ability to render services is impaired by your failure to cooperate or circumstances beyond the reasonable control of Klepps Inc., Klepps Inc. may choose not to provide services. Service can also be denied if dangerous or unhealthy conditions are present including possible code violations.

For any un-installation services provided, Klepps Inc. shall not be responsible for repairing any damage or changes made to your residence.

On Site Cancellation
If you cancel your service or installation order while Klepps Inc. is on site, Klepps Inc. will cease work. You will be responsible for hours worked by technician(s) up to cancelation time at our regular hourly charge plus cancellation fee but no more than the initial proposed cost.

Missed Service or Installation Visit

If you or your authorized representative is not at the location when the technician arrives, the technician will leave a card to let you know he or she was there. If this occurs, you will be charged Klepps Inc.’s standard cancellation fee in effect at the time, regardless of whether you reschedule your appointment.

Labor Only:
Installations do not include any parts or accessories (for example, wire, cable, speaker mounts or similar parts), except as specifically described on the product page for the applicable installation service.

Customer’s training
Klepps Inc. will allocate from 15 min to one hour to train the customer, based on the job size. If later, additional training is required, customer agrees to pay a round trip charge plus labor charge at a discounted cost of 50% of the regular hourly cost.

Privacy policy:

We receive and store any information you enter on this website or give us in any other way. This information includes demographic information and contact information such as names, addresses, phone numbers, fax numbers, and email addresses. You can choose not to provide certain information, but then you might not be able to take advantage of our features or conduct transactions.

We use the information that you provide for such purposes as responding to your requests, fulfilling your orders, customizing future shopping for you, and communicating with you. Occasionally we will contact you with special offers or to request feedback. You always have the choice to opt out of receiving future mailings.

We may share customer information with our affiliated businesses to package, ship and fulfill your order, or with manufacturers and/or service centers to return and/or repair your product. 

We are not selling your information to others. However, we release account and other personal information when we believe release is appropriate to comply with the law, enforce or apply our Terms of Use and other agreements, or protect the rights, property, or safety of Klepps, Inc..
